Legal Fees

 

GENERAL PRINCIPLES - PRESCRIBED BY CODE OF CONDUCT RULES
 

There are many matters and undertakings in respect to which it may not be possible to predict fees. Such matters may involve litigations or may be non-contentious such as advising and assisting in the establishment of an investment project. At the end of such matters, a fair and reasonable fee will be determined using available guidelines. Regulation 61 of the Legal profession (Code of Conduct) Rules 61 prescribes the following factors which may be taken into account::

 

(a) the time and labour required, the novelty and difficulty of the questions involved and the skill required to perform the legal services properly;.

(b) the likelihood that the acceptance of the particular employment will preclude other employment by the attorney;

(c) the fee customarily charged in the locality for similar legal services;

(d) the amount involved (if any) or the value of the subject matter;

(e) The time limitation imposed by the client or by the circumstances;

(f) the nature and length of the professional relationship.

(g) the experience, reputation and ability of the attorney concerned
